A monthly look at the looniest lawsuits in the land
(Sacramento)- Central California Citizens Against Lawsuit Abuse (CCCALA) has announced its latest Loony Lawsuit for the month of March. This month’s frivolity looks at how personal responsibility is a thing of the past and the current mantra in the U.S. court system is “it’s not my fault.”
In Orlando, Florida teens looking for a little excitement have started a new trend called ‘garage jumping.’ This pastime requires teenagers to leap from one 80-foot high parking structure to another. However, what happens when the jumper misses? Is it the teen’s fault? Not in the eyes of personal injury lawyers.
Attorney Vincent D’Assaro has filed a lawsuit on behalf of an 18-year old Florida man who after attempting to make a jump from one parking structure to the next— a distance of just 2 ½ feet— missed, fell six stories and knocked himself unconscious. What grounds were given for filing a lawsuit? D’Assaro contends that the fence at the edge of the structure was “very, very short” and inadequate to prevent a teen from (deliberately) making the jump.
“Under existing law everyone is responsible for his or her own actions,” stated Diann Rogers, executive director for CCCALA. “Everyone should take personal responsibility not only for the result of his or her willful acts, but also for any injury brought upon them by those actions. The trial attorney in this case on the other hand, would like the public to believe that responsibility should fall to the owners of the parking structure for giving the teenagers the opportunity to jump.”
So the question remains, who is responsible? According to the teen’s parents, “both garages need to take responsibility” for this accident. Most people would tend to disagree with that statement and believe that the responsibility should rest with the young man who decided to make the jump.
